Keith Vaz (Leicester, East): I congratulate my right hon. Friend on his continuing to play a pivotal role in the enlargement process. He will know of the case of Catherine Meyer, which has been raised with him before. He will also know that last week at the Foreign Office an undertaking was given to Lady Meyer that he would raise her case with Chancellor Shröder. Was he able to do so and what action does he think Chancellor Shröder will take to improve the operation of the German courts?

The Prime Minister: As my hon. Friend knows, the issue to which he refers has been raised many times in the past few years. I should tell him that I have today written a letter to Chancellor Shröder about the subject. I am well aware of the concerns that he expresses and he will know that they are shared by many people.

Marie-Thérèse Hermange, member of the european parliament, Vice-President of the commission for employment and social affairs, President of the group « Family and child protection » has invited us to the meeting "rendez-vous des Jeudis de l'Europe" on octobre 10th, 18h30 - 20h30, at the french information office of european parliament, 288 Bd Saint Germain, 75007 Paris, to discuss about
« which european cooperation is needed to rule on parental authority by children of binational parents? »

CEED proposes :

The achievement of 3 objectives:
1- To declare and punish cross-border child abduction in the same manner as a crime, as proposed to the members by the European Council in its resolution 1291 of june 2002,
2- To inscribe the right of parents and grandparents as a personal unalienable right in the Declaration of Human Rights and in an European constitution to come,

3- To put in place a European family court which would authorize parent associations and non-governmental organizations to represent the interests of the principal parties concerned, the parents.

The immediate implementing of 5 measures:

1- To immediately and temporarily suspend the custody rights of the abducting parent as well as the legal guardian who ignores the visitation rights and duties of the other parent,

2- To immediately suspend any payment of child support to any state in the Union which does not guarantee the enforcement of visitation rights of children in another country of the European Union,

3- To reorient the mission entrusted to European family courts to guarantee the enforcement of the free access of every child to both of his parents, to harmonize and put the parents back at the heart of the process of their separation by limiting the interveners and the procedural framework having to do with child custody,

4- To create a Central European Authority for the respect of regulations and inter-community and international agreements, and to give it the power to override the jurisdiction of one of the states which does not respect the international agreement.This authority can be taken by the offended parents.

To edit and furnish to the Central European Authority a pamphlet, explaining in simple terms, in the main languages of the Union, the interveners, the procedures, “the rules of the game” in force in the states concerned. The contents of this pamphlet are immediately available on the Internet,

5- To define a temporary legislative framework, in which the proceedings having to do with custody, visitation and housing would ultimately lead to the preservation of the children’s bilingualism and therefore ensure their communication with both parents.
