According to their universal GERMAN law, Germans can issue PREVENTIVE arrest warrants in civil matter of divorce, even before the "crime" has been committed - see :

(Strasbourg/ - OK-ek) This is a European arrest warrant as commonly issued by Germans in divorce (civil) proceedings, which has been not decided on the merits ... Now let’s look at the dates when the arrest warrant was issued and the supposed “crime” committed; The arrest warrant was issued on the 24th of AUGUST 2008. The supposed “crime” was committed on the 14th of SEPTEMBER 2008. How can this work? How can an arrest warrant be issued for a supposed “crime”, which will be committed 3 weeks later ? What is this ? Has the italian Government allready lodge an official protest with Germany or is everything allright here? ... Never think the Germans will admit they made a criminal error and will offer some apologies. They will argue that such criminal decision are "deutsch-legal" and will try to conceal it.

(Strasbourg/ - OK-ek) The debate on the European arrest warrant (EAW) to be held at the June part-session in Strasbourg will provide an opportunity to condemn yet again the untoward procedures employed by the German judicial authorities against non-German parents who are separated from their partners and who leave Germany taking with them their under-age children.
1. When will the Commission finally grasp that something is not working in the area of family law in Europe?
2. When will it realise that certain procedures, such as those employed in Germany against non-German parents who are separated from their partners, invariably lead to such persons being denied custody of their children, to the benefit of the German parent involved?
3. When will it recognise that the outcome of the judicial procedures employed by Germany is that the non-German parent is denied access to his or her own children, in flagrant breach of the principles laid down in the Hague Convention on Protection of Children and the 2003 Brussels II Regulation, which stipulate, inter alia, that the children’s views should also be taken into account when it comes to deciding which country they should live in?
4. Does it regard as normal, admissible or legitimate the use of the EAW against a mother who is guilty only of loving her own children above all else?

German lawyers blackmail non-German parents with the love they feel for their children, to put them under house arrest within the German jurisdiction in order to exploit their manpower, threatening of losing a child, if they do not comply with the German order. In the situations described by the Honourable Member the Jugendamt applies German family law and not EC law. ... Neither the Brussels IIa Regulation nor the German implementing legislation attribute to the Jugendamt a particular role in the application of this legal instrument. The world can't imagine how Justice is ruled in modern Germany. JUGENDAMT and judges follow other aims than to set equity

For a citizen of the modern democratic world, it hard to imagine that German officials and Governement could dare to betray their partners again, the same way they have done it in Munich 1938. None would imagine they could have instrumentalized their Justice administration for that purpose. In order to prevent the democratic world from committing same error as in the past, CEED shows some cases of modern German justice.

When the foreign parent arrived at the office of the clinic for child and youth psychiatry of the Reinhard-Nieter-Hospital he was taken to a small upstairs room with a floor area of about fifteen square metres. The foreign parent was locked in the room with two social workers to guard him, for a period of about fifteen minutes before the children arrived. The door was unlocked and the children were allowed to enter the room guarded by an additional two individuals, the door was again locked, neither the children nor the foreign parent were free to talk to one another out of fear of saying the wrong thing, in fear of the two guards who had remained to supervise every move made and overheard ever word said ...

British and american parents and other foreign parents are today often treated roughly UNFAIR by German family courts and minor civil servants of JUNGENDAEMTER. Their children are "tear off " by German administration and DISAPPEAR for ever from their life. Those parents are condemned to pay alimmony .for children they will never see again and are often THREATENED by German civil servants. This happens HIDDEN every day in modern Germany. Non guilty victim parents are ashamed to speak about it. They culpabilise and suffer an entire life of it.
German officials of the JUGENDAEMTER and FAMILY JUDGES deal brutally, often illegaly and BENEATH HUMAN DIGNITY with us. We, victim parents (from GB, France, Italy, USA, Poland, Turkey, ...) are not willing to endure this German official behavior any longer. To steal children from others is DESPICABLE. To do it under German pseudo legality is INTOLERABLE. European government representatives are requested to tell it to our German, before it is again too late. Non German justice should protect their their fellow citizens.
